Agreeing to these terms
These Terms of Service ("Terms") govern your use of the Capital Selector website and the advisor, tools, and services on it (the "Service"). Capital Selector is operated by Capital Selector LLC, a Wyoming limited liability company ("Capital Selector," "we," "us"). By using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
What Capital Selector is, and is not
Capital Selector is a financing marketplace and advisory service. We do not lend money, and we do not make credit decisions. We help match businesses to third-party lenders and funding providers in our network. Any financing you receive comes from, and is underwritten by, a third-party lender under that lender's own terms and agreements, to which you contract directly.
Matching is not an approval, offer, or guarantee
When we say your business is "matched" to options, we mean your profile aligns with programs offered by lenders in our network. Matching is not a credit decision, a commitment to lend, an offer of financing, or a guarantee of funding, amount, rate, or terms. Those are determined solely by the lender after its own review. Any amounts, ranges, rates, or schedules shown on the Service are illustrative and for education only. See our Disclosures for detail.
Eligibility
You may use the Service only if you are at least 18 years old, are using it for a business (not personal or household) purpose, and are authorized to act on behalf of the business whose information you provide. The Service is intended for businesses in the United States. Financing products, availability, and eligibility vary by state and by lender.
The AI advisor and information provided
The advisor is an automated assistant that provides general information to help you understand financing options. It is not financial, legal, tax, or accounting advice, and it can make mistakes. You are responsible for your own decisions and should consult your own advisors. Nothing the advisor says is a promise of funding or terms.
Communications and consent
By providing your email address or phone number, or by messaging us on a connected channel (such as our social or messaging accounts), you consent to receive communications from us and from lenders you are matched with, including messages sent by automated systems, related to your inquiry and application. Sign-in codes and application updates are transactional. You can opt out of non-essential and marketing messages at any time using the unsubscribe or opt-out method in the message; message and data rates may apply.
Your responsibilities
You agree to provide accurate, current information and to only submit information you are authorized to share. You agree not to misuse the Service, including by attempting to access it without authorization, scraping or harvesting data, probing or overloading it, reverse-engineering it, interfering with its operation, or using it for any unlawful or fraudulent purpose.
Third-party lenders and services
The Service relies on and links to third parties, including lenders, our lending-technology platform, and communication and analytics providers. We do not control them and are not responsible for their products, decisions, acts, omissions, or content. Your relationship with any lender, and any financing you accept, is governed by that lender's own terms and privacy practices.
No warranties
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, that any information is accurate or complete, or that you will be matched with, approved for, or funded by any lender.
Limitation of liability
To the fullest extent permitted by law, Capital Selector and its operators, affiliates, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits, revenues, data, or goodwill, arising from or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed one hundred U.S. dollars (US$100).
Indemnification
You agree to indemnify and hold harmless Capital Selector and its operators and affiliates from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any law or third-party right.
Intellectual property
The Service and its content, design, and trademarks are owned by Capital Selector or its licensors and are protected by law. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for its intended purpose. You may not copy, modify, distribute, or create derivative works from the Service without our permission.
Changes and termination
We may modify or discontinue the Service, or update these Terms, at any time. Material changes take effect when we post the updated Terms with a new date; your continued use means you accept them. We may suspend or terminate your access if you violate these Terms or misuse the Service.
Governing law and disputes
These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-laws rules. Any controversy or claim arising out of or relating to these Terms or the Service shall be determined by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, and judgment on the award may be entered in any court having jurisdiction. The arbitration shall be seated in Wyoming and conducted in English. To the fullest extent permitted by law, you and Capital Selector agree that claims may be brought only in an individual capacity, and not as a plaintiff or class member in any class or representative proceeding, and each waives any right to a jury trial.
